12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 5E CLUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE USE OF THE SERVICE.

IN NO EVENT SHALL 5E CLUB'S TOTAL LIABILITY EXCEED THE GREATER OF:

(A) THE AMOUNT PAID BY YOU TO 5E CLUB DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR
